FDLE Summary
You will be reading the summary report of FDLE that was sent to State Attorney Bill Cervone. As mentioned earlier and necessary here are three points among the rest:
Note the allegations on page one and the nearly immediate recantation by secretary Gallagher.
Keeping in mind the earlier lengthy summary of both my wife and I, please note all of the leads an experienced investigator would have followed up on. Unfortunately, because I tried to paint as good a picture as possible during this “live” interview and still trying to recall what I had done during a five minute session at the tag agency two years prior. My attorney had likewise noted to one of Darnell’s people that the tax collector does not ask questions; rather they have the registrant sign the title and pay what they are told to pay. The state attorney even referenced it in his letter to FDLE.
When I say to the investigator that I have not paid sales tax before I was talking about purchases off the internet! You know eBay, etc. In fact, I had just purchased a GPS for my wife and there was no separate tax line.
As an aside from the registration of the vehicle; the State of Florida has since changed the layout of the vehicle title to have the registrant specifically state whether the car was a gift or the actual price. As another aside, I had occasion to turn another car over to my oldest daughter and when I went to the tag agency the clerk said, “Sign here, sign here and initial here” and I was done. That scenario is probably familiar to many of you. Additionally with emphasis added, when I did get to the tag agency, after learning about my mistake, to square up the sales tax due, the representative would not entertain any penalty payment for the two years of no sales tax, nor would she impose a surcharge; rather said this was no big deal and just the due tax was more than sufficient!
